Newmark Learning LLC and its affiliated companies (collectively, the “Company,” “Newmark,” “we,” “us,” or “our”) are committed to protecting your privacy. This Privacy Policy explains how we will use, disclose and protect your information. It applies to websites and applications, including benchmarkeducation.com, newmarklearning.com, reycraftbooks.com, and others (collectively, the “Sites”) that are owned and operated by Newmark Learning LLC, Benchmark Education Company LLC, or one of our affiliated companies.  By visiting the Sites, you agree to the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Sites.

The Sites are hosted in the United States. If you are located outside of the United States, the information you provide will be transmitted to us in the United States. The information will be subject to this Privacy Policy and applicable law.  By using the Sites, you agree to this.

 

The Information We May Collect

We may request and store certain types of personally identifying information about you when you use our Sites, depending on how you interact with the Sites. We consider the following to be examples of personally identifying information: your first and last name, email address, home address, phone number, date of birth, social security number, student identification number, credit card and banking information, and other similar information. We do not collect personally identifying information about you unless it is voluntarily provided and needed for the delivery of services you wish to use. It is your choice whether to share personally identifying information with us but please keep in mind that in some instances such information will be required in order to participate in activities within the Sites. Please note that we DO NOT consider anonymized or aggregated information to be personally identifying information.

We may also collect any comments, feedback, posts and other content you provide to us; any communication preferences; purchase and search history; and location-aware services, including the physical location of your device in order to provide you with more relevant content for your location.

 

Why We Collect Information

We use information that we collect about you or that you provide to us, including any personal information, to present the Sites and their contents to you, to personalize and improve your experience, to provide you notices, to send you information about BEC products or services, and to fulfill any other purpose for which you provide us the information.

For certain services, we work with third parties. These services include technical, payment, and delivery, advertising, data and analytics services. They may supply us with information about you.

 

Cookies and Other Technology Used to Collect Information

With the use of cookies and other technologies, we may receive and store certain types of information about you whenever you interact with the Sites.

Sharing of Non-Personally Identifying Information with Third Parties

We may share with third parties (including advertising companies and networks) any anonymized information collected through the Site, including those collected using cookies or other technology. In such instance, we do NOT provide such third parties with any personally identifiable information about you or any other users of the Site.

 

How We Use Your Information

We never sell or rent your information.

We may use your personal information in the performance of any contract or transaction we enter into with you, to comply with legal obligations, or where we have a legitimate business interest. Legitimate business purposes include but are not limited to one or all of the following: providing direct marketing and assessing the effectiveness of promotions and advertising; modifying, improving or personalizing our services, products and communications; detecting fraud; investigating suspicious activity and otherwise keeping our site safe and secure; and conducting data analytics.

 

Information Shared With Third Parties

When you conduct a purchase transaction through the Sites, you are providing transaction information to our third-party suppliers (such as transaction processors and financial institutions) who will use the information solely for processing your requested transaction. There may also be other third-party vendors who supply software applications, web hosting and other technologies and/or services for the Sites that may have access to your personally identifying information but, unless they get express permission from you, they will not use such information for any other purpose other than to provide services in connection with this Sites.

 

Information Storage

All information is stored in the United States of America, regardless of where you are located. If you do not approve of storage within the United States of America, please do not use the Sites.

We will not keep personal information longer than is necessary for the purpose for which it was collected. Unless information must be retained for legal or archival purposes, personal information will be securely destroyed, put beyond use or erased from our systems when it is no longer required or, where applicable, following a request from you to destroy or erase your personal information.

 

Do Not Track

The Sites does not respond to your browser’s (or app’s) “do-not-track” signals or comparable signals or mechanisms. Please check our Privacy Statement frequently as this may change in the future.

Links from the Sites can take you to other Company sites, as well as to third-party sites and resources (collectively, “Other Sites”). The information practices of such Other Sites are not covered by this Privacy Statement or any other policies or terms of this Site. Changes to Privacy Policy

Newmark may amend this Privacy Policy from time to time. When we do, we will notify you by updating the date of this Privacy Policy and posting it on this page of our site.

We strive to maintain reasonable security standards to safeguard your data. The Sites have multiple security measures in place to protect the loss, misuse or alteration of information under our control. These include encryption of data in transit, regular software security updates and industry best practices for network and physical security.

Nonetheless, please be aware that no data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit or otherwise provide to us and you do so at your own risk.

If you create an account, you will be asked to select a password for both yourself and each employee and student to access the Sites. Users are responsible for maintaining the strict confidentiality of account password(s), and for any activity that occurs under your account credentials, whether or not authorized by you. Please notify us of any unauthorized use of your account or any suspected breach of security.
